NOMINATIVE FAIR USENominative use becomes nominative fair use when (1) plaintiff’s product would not be identifiable without the use of the trademark, (2) use only as much of the trademark as is necessary to identify the plaintiff’s product, (3) the user does not do anything to suggest sponsorship by the trademark owner.
